If the Purchaser cannot receive the product in time, quality and quantity due to failure of Customs (exp, failure Commodity Inspection and Inspection of Health or other) clearance because the quality is not in line with the regulations and the requirement Government of China, will be charged to Buyer or Seller all costs, due to the obligations assumed herein, unless the problem occurred due to transport or is attributable to transportation companies.
If the Seller is prevented from performing the contract because of force majeure, the Seller shall not be liable. However, Seller shall notify Buyer immediately. Should the effect of force majeure continue for longer than 15 days, the Buyer shall be entitled to cancel the contract and the seller must return the entire amount paid for the buyer will pay goods and undeliverable.
