急问诸位地主大师们，租客file了bankruptcy

我们去年在sacramento买了投资房，租给一个人带着儿子，和他的女朋友及三个小孩，签了两年的Lease.此人在州政府工作，收入不错，大半年来租金从没有晚交过。为修fence 等打过几次交道，感觉他是个family man，和女朋友关系也稳定。本以为找到了一个好租客，没想到上个月4号 收到rent的同时也收到法院的信，说他在 12/30/09 file了bankruptcy。我打电话去问他，他说他趁州政府裁员，拿了一个early retirement，现已又找到另一个工作，几周后就去上班，也趁机file bankruptcy,解决其他债务。他很肯定的说还会按时付租金，和我们的一切都是business as usual,I don't need to be concerned at all.

Well,今天已是2月7号，我们还没收到1号due的租金。通常我们有5天的grace period，在5号前收到就没有late charge.我们在湾区，租金是邮寄过来的。昨天2月6号没收到check,我们给他和他女朋友打电话，没人接，今天再打也不接，昨天发的e-mail也没回。我们开始担心，上网去查，好像如果tenant file 了 bankruptcy，landlord 都不能serve three day pay rent or quit notice的？是他一个人file的，我们可以给他女朋友发吗？他们两人都在lease上。如果他们继续拖延不交租金，我们可以驱赶他们（eviction)吗？如果不能，大概会是多大的损失，比如说半年的租金？
