We did some more research late last night, and are still confused. Some say the automatic stay is only for 30 days, if that is the case, my tenant filed bankruptcy on 12/30/10, it already passed the 30 day mark now. we will try to find an attorney for consult today.

SR99, the thing is his girlfriend can still rent a house. When we chose to rent to them last year, one of the main reasons was both of them had good credit scores ~700.

Lessons learned: this tenant filed bankruptcy back in 1990. The explanation he gave was he went through a nasty divorce then and used chapter 7 to protect himself. I thought it was almost 20 years ago I could ignore that. Wrong, like va_landlord said, they tend to do it again!
