before the verdict of the criminal court, it would have been a clear obstruction of justice by definition in any states. Now, the DA' office can either go after it, or leave the plaintiff use as evidence at the civil court. No matter what, it doesn't help the defendant. As to definition in legal terms, different people interpret differently. The decision is always made by the judge. Let 'see what evolves at the civil court.
