In my state (PA), you buy not only liability, but also uninsured/underinsured coverage, which kicks in when the other party caused the damage to your car and the other party didn't have insurance or have insufficient coverage to the damage. In your case, I can use this policy.

Not sure if this coverage is nationwide though.
