One article headline was "UA had the right to kick off the passenger, but does it have to?"

 

Let's get it straight, No airline has the right to kick off a paid passenger. Yes, FAAregulation says airline have the rights for overbooking, but when overbooking does happen, it must be negotiated. Airlines do not have the right to kick off a paid passenger. 

付钱买票， 本身就是商业合同。 当一方不能执行合同时， 不是犯罪， 一方可以选择不执行合同， 但必须要另一方同意才行。 如果另一方不同意， 这方要补偿， 补偿条件必须要另一方满意为止， 否则合同要执行。 Overbooking 是允许的，  FAA只给了这个权限。 但overbooking的后果是航空公司自己承担。

 

何况这次不是超卖， 而是航空公司因为自己的问题要把四个工作人员放上去。 为什么航空公司自己的问题要乘客承担？
