Fidelity's answer is for participants; Check with your CPA or Financial Advisor - If neither you nor your spouse is an active participant, you can deduct 100% of contribution regardless of your income.

I am very confused on your financial information and curious about how you handle your retirement plan. I think your first step is to identify if you are an active participant.
