美国法庭问题思考

美国法庭在轻罪判决后不可以上诉，这样就对法官没有了制约力，如何能够保证公平？难道靠道德吗？

在中国大陆，判决后不服可以在指定日期(10日)内上诉至上一级，而美国没有类似机制，是否说明中国更有人权？
