上星期我从court house 买了个银行拍卖房,当时付了10%的deposit给Referee并在Sale Contract签字。在拍卖之前,我从foreclosure网站上查到这个property包含2 lots,lot 1 是 25*100, lot 2 是 50*100 with house. 当时这个property竟拍很激烈,最后winning price 比银行出的upset price 高出很多。我签的contract上也表明有lot 1 and lot 2。随后我将sale contract 交给律师并order title search.
今天律师告诉我Referee要卖的只是entire lot 1 plus partial lot 2(based on title search). 昨天我收到Bank律师寄来的Deed Copy 也表明前Owner只卖entire lot1 plus partial lot 2 给现owner.
问题是我出的价钱比这块空地的market price 还要高。所以我请律师写信给Referee要求Cancel contract并要回deposit。Cancel的理由是Contract上没注明partial lot 2。
请问大师:
1。我可以要回这deposit吗?
2。通过Referee就可以cancel contract吗?是否需要通过法庭程序才能cancel并要回deposit?
请大师帮忙,我该如何处理这棘手的foreclosure sale?
