本人最近遇上一件极麻烦事。以下是用英文写的。相信把事情说的很清楚了。
请赐教。尤其是有否好的劳工法律师可以推荐。联系方法:dcresley@yahoo.com
Hi,
I have worked in a big company for 4.5 years as a principal software
engineer. My performance was fine up until 6 weeks ago, when I was
suddenly pulled to a big new project. The task was intially
planned for 30 days, but when they assigned to me, they required
me to complete it in only 3 days. I have no prior
experience/knowledge about the big software framework that
I need to use. Three days were not even enough for me to
finish reading! To start wtih, I told them (in email) that the
schedule is ""very tough", and managment need to have a
backup plan. Nevertheless, I still tried my best and worked
days and nights for it.
Not only was the schedule ridiculous, but I could also not
really do anything because,
1) There was a critical dependency not fulfilled by other group.
I could not even get my work environment set up.
2) On the third day, there was another emergency happened in
a project that I was already responsible for, and they
assigned me to work on that project, which kept me working
on the Friday and the whole weekend.
Next Monday, when I met the manager, he said that I was slow,
and there was a "performance problem". I immediately reported
this to the HR. However, after a month's investigation,
HR ended up maintaining his conclusion.
I feel this is very unfair and want to seek legal services.
Two critical supporting points:
1: Later, they assigned the task to two other engineers in the group,
and they took more than a month to finish it.
2: I talked to our chief architect for this project, and he
also said this was not an "overnight" task, and that we were
not even ready to jump into implementation at that time.
I was deeply hurt from this incident! I worked so hard,
and was almost sleepless for many consecutive nights, because
of the work pressure and the unfair treatment. My health was
already damaged. After the incident, I had to take a lot of
sick time (I have the doctor's notes available).
Please consider if I have a case against this company, in the
lines of "workplace slavery", "huam rights violation",
and "infliction of emotional distress", etc.
