一个租公寓遇到的问题

三月中看好了一间apartment，会在4月8日空出来，于是交了400美元的deposit和50美元application fee，计划四月底搬进去。结果到了四月中，公寓管理人员来电话说原来的resident要到5月5号才能搬出来，说这是一个残疾人，他没办法按时搬，问要不要force him out，当然我们说不要这样做。又看了这个公寓别的apartment，都不满意。

等了一个星期，这个公寓也没有什么别的说法，因为我们现在住的地方lease在4月30日到期，所以就决定把交的450美元要回来，赶紧到别的地方去找apartment。结果公寓的人说，只能退回400美元的deposit，50美元的申请费已经用于run application了，不能退还。

要说50美元也不是什么大事，丢了就算了。不过这事让我老婆气得够呛，特别是我老婆第二次去找他们，公寓那人态度还很坏。

所以想问一下，从法律上讲，公寓那方是不是应该退回50美元的申请费呢？ 这件事明显的是公寓那方的造成的问题，任何损失应该由他们承担，而不应该由我们承担。 因为他们不能履行承诺，实际给我们造成了损失，因为这么短的时间在别的地方也很难找到满意的apartment。

如果这种事要上法庭，又是怎么做呢？只是在电视上看过，小老百姓为百十美元的事争论，到法庭上法官听了陈述、看了证据，锤子一敲就定案了，还很有意思。想找公寓的manager，说是度假去了，说了昨天manager回电话，也没消息。前天打电话到公寓总部，接电话的人把事情记下来了，到今天也还没消息。
