Advice needed for car accident

I have a car accident on June 17th. My car is totaled. It is clearly the other person's fault. He got arrested at the scene. Yesterday his insurance company called me saying that person only has $10k property insurance, but my car is worth more than that amount. On top of it, I need car rental etc. My own insurance company saying I do not have collision coverage, so I have to deal with the other person’s insurance company by myself.

I had minor injuries -- even through the X-Ray's showed no fracture, but I have been experiencing neck pain and shoulder pain since then.

Under this situation, should I hire a atterney to collect the uncovered property money? Please advice. Thank you!
