My hu*****and just run into a problem with his employer and have to resign immediately. He worked for a subsidary of a very big company. He started his job last year. the employment contract is for 18 months till the end of 2007. His base pay is very low. but they guaranteed minimum bonus at each year end. His job is very hard and demanding but he made through it. Last year, he received a very good performance review and he received 50k more than the guaranteed bonus. Per his boss at that time, it's very unusual to pay more than guaranteed. That means he did very good job. Then this year till a couple of weeks ago it seems fine. It's a tough job but manageable. Recently, everything changes very abruptly. As his responsibility involves a lot of communication with the parent company, now the top guy of the subsidary don't allow my hu*****and to communicate with the corporate. However, the corporate people keep asking my hu*****and questions regarding the issues in the subsidary. You see, that put my hu*****and in a untenable situation. He has no choice but resign, the sooner the better. It's a set up. He was told not to communicate with corporate. If he didn't, when the corporate asked about that, my hu*****and's employer will point the finger to my hu*****and. Of course, they are smart enough not to leave any evidence. They just told him orally. The issue here is based on the contract,if they lay off my hu*****and, they'll still have to pay the bonus. But if my hu*****and resign or they could fire him with good course, they don't have to pay the bonus. But to us, it's a very unfair situation. My hu*****and worked so hard for eight months but get extremely underpaid. and he can't stick around till year end per the situation I described above. That will bring him real trouble since they want to frame him. That subsidary has a very wierd culture. It's small. the top guy has the absolute power over everything. No people surrounded you can talk to or go to HR etc. His direct boss just throw him into the wheel. We want to get the bonus and we are considering file a law suit against his employer. Old cat, would you please give us some ideas as to the chances to get the bonus? or if you know whether there are attorney who could take on the case and get paid based on the percentage of outcome?
