可以和他谈，但是你不能接受租金

只要他租约满后你不收租，他就是holdover tenant，驱逐程序简化。

如果你收租，他就是month-to-month tenant, 需要发通知。

当然要看你的租约，里面有没有规定到期后自动变成月租。（month-to-month）
