第一次做房东，加州，关于UD，求助老猫

买了房准备自住，但老房子还没卖，所以租出去了，fixed term 6/30 到期，用的标准lease form。tenant表示要extend another term， 同意加5%， 但就是找理由不签extension，说是要迟几天再签，30号说3号，然后5号说9号，因为是fixed lease expired/terminated， 我没有给3day or 30day notice。 到5号我verbally告诉他不签不能住那，他还是拒绝了。6号file for UD - 加州law fixed term lease expire 6天内可以file UD，不必written notice。现在tenant收到Summons后表示很委屈，说是不知道我明确要他们搬走。还是想要再续签。我想问，要是跟他再谈是不是对Case不利？另外，加州比较保护tenant，我等了他几天会不会被认为是已有verbal agreement，只是晚付房租几天而已，从而可能lose the case？
