老實講，您的case可能很難成立，因為對方lay　off 您的理由是有關公司經營的問題，並不是針對您個人，由此而言，所以您的公司大可說，您的公司確實想keep 您，只是基於財務的考量，"不得不"lay　off 您，很不幸在美國這種情況很普通，所以您沒有什麼可以做的，只能令謀高就了。
