请问怎么追讨私人债务

前年借给本地教会4万刀，本来应该是一年到期，但是他们一直应该入不敷出，一分钱都没有还我，每次去和他们谈，都是哭穷，是不是只有去告他们了？但是如果赢了，能把钱拿回来么？我现在需要这笔钱买房，不能再拖下去了，也有朋友说，如果拖的太久，因为statu of limiatation 的原因，就不能告他们了，是这样的么？
我也很担心他们直接宣布破产或者人去楼空，我是不是彻底没法拿回钱了？
