Joint Tenancy With Right of Survivorship---With a JTWROS, the surviving partner becomes the sole owner with no strings attached. So if you die, your spouse will own the house outright. And if, in the case of a second marriage, her will says the house is to go to her children upon her death, then guess what? You just disinherited your own children, and there is nothing they can do about it.

要问的是两口子的财产没有分开,立Living trust,那两口子也该是trustor/trustee。一个死了,下面一个就takeover,全权决定吧。真要做到自己的财产留给自己的孩子,估计两口子的得分开,或指定多少留给自己的孩子。如果财产有限,自己的老婆/劳工也就能用来survive,留给子孙也是空话。
