学校的h1b 可以transfer到industry？

本人学校博士后h1b
一个公司给offer，
本来已经开始办新的h1b了，打算10月出开始
今天收到公司hr的email：

xxx（律师）  just informed me that your H-1b is subject to the cap.  With
that said, you can start sooner with us (ether upon filing or with the
approval notice) rather than in October.

这是怎么回事，
是律师搞错了吗？
