you and everybody a true story happened to one of my friends. This happened in mid-90's, at that tiem, friend's employer was trying to establish presence in the China market, There was an expat opportunity to be the head of company's China operation. She was very interested in the opportunity and puesued it very aggressively. However, company selected another person for the post. That person is also a Chinese and jointed company much later than she. She complained to the company that she was more experienced and claimed to EEOC that company discreminated her because of her gender. The EEOC investigation lasted about two years, during which she was unable to find another job and the company cannot fire her either.
Eventually, EEOC did not agree with her claim although EEOC found some discrepancies in company's practice. So, she and company settled with some compensation. After that she tried very hard to find another job, but was unable to because the publicity of the case made her a bad name in the local business circle. She become seriously depressed, got cancer a few years later and passed away.
What I am trying to say is that even you win the EEOC claim, it won't get you out the delima unless you will start over doing something else. Given the time and energy consumed in the investigation, one would be much better off to just move on.
