请麻州地主或懂麻州租房法律的帮忙看看， 谢谢

现在房客提出要提前三个月搬走。我们努力找房客，也找了中介帮忙，花了一些时间和精力找到了。租约上有写提前搬走要交一个月房租的租约中止费。请问我们可以按租约收他们这笔钱吗？是不是要写一个书面的东西，双方签字就可以了？
