Seek help on missing stock shares in account with E*Trade

In 2001, exercised 500 shares of ADEC ISO stock option with cash, this company merged with Biogen in 2003 and became BIIB.  At merge, each ADEC share became one BIIB share, so total 500 shares of BIIB.  Last year when selling 200 shares of BIIB, it was informed that only 200 more shares left in the account.  Contacted E*TRADE in the last 3 months, they found that 100 shares was transferred in 2005, but did not know to whom they were transferred to.  We never transferred any shares and they could not provide any document that we authorized this transfer and we could not find any doc either.  It is stuck right now.  E*TRADE said it was too long and they only keep record up to 7 years old.  We did not pay attention to that stock option account and did not notice the shares missing.  We can sue E*TRADE.  Just want to check here to see if there is other alternative to find a solution here.  Hate to sue and go to court.
