1. You can hire an attorney to fight the battle, the outcome is 50-50 at best because you handled the situation very unprofessionally.
2. Negociate the amount and sign a Mutually Release document to release reliability of each other.
Option 1: It can be very costy and retaintion is probably more than $1000, and an attorney will likely charge you $250/hour (and this attorney is not the best one, probably just 3-5 years out of law school, a reasonably good one will charge you $500/hour). Your chance is 50-50 at best.
Option 2: That's the tuition you pay to be a newbie landlord, especially you are not equipped with knowledge to survive in this tough business. You may not like this option, but as any business, you have to take risk control as your first priority.
There are several things you did not handle professionally
1. You have a PM, you should not be involved in lease negociation.
2. You and your tenant agreed to void the lease, but you don't have any signed document to void the lease to release liability from each other.
3. Your lease had not been voided and your liability was not released, you put property back to the market and even rented to another tenant.
4. Without the lease voided, before you rented to another tenant, when this tenant came back to honor the lease, you raised rent and required 2 months deposit while the biding lease required only 1 mont and rent was $100 lower. It was you who vioated lease aggreement without proper reason and without agreement from tenant. You can argue that the lease was voided, but where is the evidence? Of course you can argue further that tenant sent you email, you agreed and sent back the deposit, but your tenant could argue he sent it by mistake. That's why your chance was 50-50 at best.
If I were you, I would pay the price and move on.
You have to remember everything comes with a price tag.
