attitude is not right.

首先，房子已经close, now the house is yours，为了$1300，你就不怕the seller damage your house?  Even smaller damage will cost much more than $1300, especially this is a million dollar house.

For all the things you want to sue, the chance is very low for you to win.

So mend the relation with the seller, and let them stay untill January, and get YOUR house back undamaged.  That is probably the best option for you.
