恶房客被驱赶后申请 motion to set aside default judgment 怎么办

EVICTION 原因是威胁别的房客。我的EVICTION申请已经成功。5天内他没回，我接着申请了警察驱赶收回房子。警察昨天递了NOTICE，限下周三6AM前搬。可我昨天下午收到COURT通知，说下周一，SET了一个motion to set aside default judgement.我没收到关于他ANSWER的文件。我今早打电话去court，court说他今早来申请的。时间上有点不对，我是昨天接到hearing通知的，怎么说他今早去申请的？难道说court自动先set一个hearing?

他无非说没收到COURT的文件。是另一个房客给他的，有证明。还会有什么花样呢？我明天是不是值得跑一趟COURT，要一个他申请的理由，在hearing时好有的放矢呢？

如果我赢了，可不可以当时问法官让他付COURT fee？

这种坏人，别的房客都盼他走。成天拿别人东西吃，要加油钱。怎么有钱去申请motion to set aside default?这申请要花钱的吧。

有什么建议吗？先谢了。
