买房的问题出来了，能不能拿回deposit

原计划这周五close,但是前几天大雨，seller星期天刚刚回来，然后发现地下室进水，但是不说具体情况，只说地毯湿了。现在我们约contractor去看,seller也在拖检查的时间，这种情况能不能拿回deposit,有什么注意事项?
