现在under contract的那个房原来有一个有Hubbard clause 的contract, 就是buyer #1买房子是contigent on他把自己的房子卖掉。但是如果seller决定接受其他offer了,给buyer #1 24小时做决定,是remove contingency, 还是release。我们那个buyer #1 在24小时告诉他自己的agent, 他release,那时是晚上8:03。所以我们作为buyer #2 就和seller 在9pm under contract了。结果第二天早上11am, buyer #1(他自己是律师) 说他改变主意了,房子还是他的。
现在我们都不让。listing agent's attorney 认为房子应该是我们的.
buyer #1 is claiming since there was no “time is of the essence” and due to the Statute of Frauds, that he still has the right to go forward .He explained that he does not need to sell his house to buy the house[not sure how true that is].
We claim "we have a bona fide contract, that the first buyer has not dealt fairly , that we are the only party with “Clean Hands’ in all of this and expect to buy the house".
周五要inspection了,如果拿到房子的可能不大的,不想浪费那个钱了。大家帮我看看?
