After we moved in a condo apartment, we found there are animal activities in the attic and subfloor/space between the ceiling and upstair floor. We reported the problem to the landlord's property manager (a typical redneck type of guy). He has been slow to respond. After two weeks of repeated calling, he showed and said he would contact the owner and HOA. Few more weeks passed, there was no sign of any action. I had been calling and emailing him on the update and asked him to forward me any email that he had contacted the HOA. I didn't get any reply.
Since the weather here gets warmer quickly in March, I have concern of the animal droppings and smell will have negative impact on our health especially kids. I have written a 60-day lease termination to him and indicated that the living condition is sub-standard and in violation of health regulations and the owner/PM faulted on maintaining the property. He now replied saying this is out of his control and kicked the responsiblity to HOA and he insists I am liable to the full year rent.
I signed up for a 1-yr lease, but the lease states that the landlord has responsiblity for pest control (termite and rodents). I had called a wide life preventive services company. They came in and confirmed that we do have squirrels and possums activities in the attic.
Since there are a lot of experts in this forum, I would like to hear your opnions and suggest what the next steps should be and how to resolve it properly.
