I think the buyer can sign bank's form and with stipulation that buyer has the right to purchase the subject at same price once title is clear...(I wonder why buyer's agent did not come up with any recommendation??)

For the loan, you can just let the lock expire and resubmit with the same broker once the situation is clear...of course, you will bear the interest rate risk by then...
