Depends on which state you are in. In most states-
1. five (or three) day pay or quit letter by registered mail or by sheriff.
2. Still not paying, go to the small claim court or landlord-tenant court to sue them.
3. If your tenants do not show up, you win. If they show up, you will have a judgement date.
4. If you prepare all the documents carefully, you will win the case.
5. when you win the case in either step 3 or 4, the tenants will have a few days of appeal period. In VA, 10 days.
6. Right after the appeal period, make an appointment with the sheriff.
7. In most cases, your tenant might have moved out by now. But if not, then bring your locksmith and moving company to the property at your appointment.
8. In VA, we just throw them out. In some other states, you need to store their stuff for a period of time, such as one or two months, depending on your state regulation.
