The 法理根据是：

to prevent short sale fraud.

卖家的银行怕买家和卖家联合起来骗银行。 譬如说你和卖家是朋友关系，你写一个很低或偏低的offer，然后和seller讲好， 过户后免费让seller住几个月或一年， seller 把其他高的 / 好的offer 据掉，接受你的offer。这样银行就亏大了。

Basically, you want to apply short sale? you HAVE TO suffer. You have to get out, 无家可归。 No pain, no short sale.
