I have seen so much discussions/questions about Eviction. It is a very important (or basic) for landlord (new or seasoned). I suggest to have an activity like other forum on this subject and we can share. Here is what I know and my experience in Texas (North Dallas).
Texas law is in favor of landlord comparing to some other states (CA, DC...).
To file an eviction, you need good reason. Non-pay rent is most common one. In general, you can send three-day eviction notice as soon as the tenant missed the rent payment. (post on the door with witness or picture is good enough.) It costs $120~$200 court fee. In most cases, you can file it yourself as landlord. (no lawyer or agent necessory) Simple if you can read court instruction.
Normally the court date is about 12 days after you filed in Texas. It could be longer if the judge is really busy. Court will send/post a notice to the tenant at property.
In the court, judge will ask if this is a financial reason or leagal reason for nonpay rent. If financial reason, Judge will most like to grant eviction. If leagal reason, debate between landlord and tenant will decide the case.
If the landlord wins, the judge will give tenant five days to move out or appeal. And judge will grand landlord missed rent payments and court cost and possesion of the property.
If the tenant did not move with in five days, and did not appeal, landlord need to file wit of possesion. Cost $160+. Normally takes few days for police to posy 24-hour notice and through the tenant on the street. On that day, landlord beed to meet the police at property and hire someone to move the tenant personal belongings on the street.
If the tenant appeals, he/she have to pay the fee ($200+), and court date is within five days. most tenant will not willling to pay for that fee.
I have 7 cases so far: 3 due to foreclosed property bought from auction, 3 due to non-pay rent, and 1 due to damage to the property.
