haha, seems like every year, the court is issuing more new rules upon on already distressed landlords like us.
last year, the high court found that late payment penalty is illegal in state of Indiana, we must incorporated that into the rent, we must updated our new leases, to clearly state early discount rate due on 1st, normal discount rate due on 6th, and full rent rent due on 15th.
and today in court, the judge told me the 2011 NewYear presents are....
1. the court no longer allow plaintiff's motion on requesting, to order defendant turn in job research weekly report, for possible wage garnishment, we must formally file for court hearing on all garnishment orders.
2. the court will fully enforce the maximum claim allow under Indiana Status, where any corporation (including LLC) is only allow maximum of $1500 on judgment order without accompany by an attorney, while personal claims still $6000. so the new leases must carry both personal and LLC's names as landlords, which give landlords some possible liability risks.
