急问，房子不能close，怎门办？

10月份就开始申请贷款，用的是agent推荐的broker，本来觉得应该比较靠谱。当时broker给我们的rate 4.0%, 30year fix. 11月中旬这个broker按照contract要求出示了mortgage commitment，上面显示的也是同样内容（这个是broker出的，不是银行出的）。我们是头次贷款，也没有经验，而且，也没有人(buyer agent, buyer attorney, seller agent, seller attorney, seller)提出异议，房子本应该今天close，两天前，我们打电话问mortgage何时能拿到银行的 clear to close，忽然被告知，银行说我们根本就没有lock rate，现在要给我们按4.8 或5.0，30 year fixed 来算，如果broker没有lock rate 却给我们出了mortgage commitment,那不是骗人吗？我们现在能怎么办？
