My shor sale offer was approved, bank asked to close the deal by 15Dec. But seller does not want to vacate house prior to closing, and asked to allow him stay at house until Jan. 1 after holidays. The seller's agent said he can sign a short term lease. I wonder what is worse case if he still stays in the house after the lease expires. I understand state law differs, I am in CA. I wonder how long I have to wait for starting a eviction, how long does it usually take?
Another concern: what will happen if he trashes the house? The market rent is 1200. But he hasn't paid the mortgage for more than a year. I don't think he will pay this much. How much should i charge for deposit? I would like to close escrow prior to his moving out, but he just doesn't want to. And the bank does not want to extend neither.
