Ban VPDI Plans

MAJOR UP FRONT DISCLAIMER ... This thread is not meant to debate whether or not the IRS considers California VPDI plans to be tax deductible or not. The presumption of this thread is that they are not and that the conservative interpretation of case law applies ... with that out of the way ...

Why ban VPDI plans?

Because they are unfair to affected tax payers.

While an employer may somehow think they are doing their employees a favor by providing a better disability package than the state, for the vast majority of workers at companies using VPDI plans, who never take disability benefits, and yet, are not able to deduct VPDI, the negatives outweigh the positives.

The simple solution is to ban them, thereby forcing all employers to default to the standard SDI deductions, which are clearly deductible.

Agree? Disagree? Should it be a proposition?
