Landlord cannot discriminated against the tenant who used the house as a Family Day Care home even if the lease states that the premises cannot be used as a business. The only restrictions you can put on the tenant is to collect more deposits (in some state you can require 2 months rent as deposit) and negotiate some money for utilities if water is included in the rent.

If the tenant is a licensed provider, she knows the regulations such as the insurance requirement, the number of children is allowed, etc. You need to ask the tenant to put your name on her insurance policy as an additional insured.

Check with the Family and Child Services in your city or county.
