Judge can over rule it ... Or he can award penalty on bad faith, fraud ...
Remote landlord is one problem, bigger problem is some tenants are professional in finding hole in the law, easy to say rent low to good people, hard to do. My suggestion is: try to settle on law suit if it is not small claim, you cannot afford the time and money to fight even you can win. Even you win the case, you still lose the time.
