It will be hard for him to prove you discriminate against him. You can explain in the court that you just did that for convenience.

Did he pay the application fee? If so, you had better refund him if you did not check his credit.

The other question is, who is going to live there? The man or the mother? If the man is going to live there and he wants you to check the mother's credit, then you have a solid reason because you don't like the idea of co-signing a lease.
