请教投坛的加州地主及柠檬律师，出租的condo被楼上漏水泡了

楼上墙内的进水管在澡池的开关和淋喷头之间的一段漏了，水流到我的墙内，泡烂了drywall。因为漏水的地方在墙内，外面无法看到。现在他的保险说加州的法律认为这不是他的negligence. 因此，不在理赔之内。请教各位大佬，要他赔偿修理的费用还有戏吗？这是他的保险的邮件：
