房客背景调查的limitation，和知识盲点分享

和大家分享一下最近做房客背景调查所学的的新知识（以前对我是盲点），和提醒各位房东关于evction需要关注的事项。

最近一个小公寓招租，并不是很顺利。房子全部粉刷，新地毯，新电器，租价还比之前全是旧的要低一百块。在zillow上登了两周都没有什么人问。有直接申请的又收入或信用分数太低。

终于等来了一个申请人，在同一小区自住房居住超过十年，现在准备卖掉套现，但又不想搬出小区，所以很想租我的房。他也丑话说前面，年轻的时候干过傻事，做过两次牢（轻罪，几个月就出来了）。长话短说，我考虑了他。付申请费，做背景调查。我用CT credit买的value package which includes crminal record. 报告出来，criminal record无记录。我给CT credit打了电话询问，下面是知识点 - 

1）evcition record/crminal record都只能显示过去七年。

2）我不能因为applicant有crmianl record就turn down。如果这样做，我是犯法的。Applicant可以告我。

3）Covid 19 期间的evcition record是受保护的 （March 2020 - June 2021），不会显示在applicant的report 里面。

所以如果各位近期收房客，要警惕申请人是否可能是被evict出来的，有记录但report上又不会显示。当然很多州当时停止了eviction，所以这些人连记录都没有。

Please be advised that any company who furnishes credit, criminal and eviction background reports are regulated by Fair Credit Reporting Act as well as  Fair Housing Act by each state.  This regulation enforce the status of limitation of criminal records which would be 7 years.   Therefore any criminal records older than 7 years can not be released on the tenant screening report as it would be a violation of FCRA and Fair Housing Act.
