AB1482说,只要房客守法付租十二个月以上,房东不能够单方面结束租约。很多房东哗然,租约到期了不让我单方面结束租约,限制了我的自由。
那么我反问你一句,房客守法付租不破坏房子,租约到期后想续租,你为什么不想让房客住下去?你不想赚钱吗?法律允许你每年涨10%的租金啊。房东终止租约的合法理由是翻修,卖房,或者准备自己住。
房客付租金你不想续约,不外是觉得房客不好相处,太麻烦。这个在一个正常市场里面,不是什么坏事情,自由经济么。
但是在一个住房短缺的市场里面,房客“不听话”就不能续约,在客观上导致房客不敢维权,不敢抱怨,因为怕租约到期房东把自己赶走。那么房东修理不尽力,甚至房子里面东西运作不好,在一个住房短缺的市场里面,房客更加不敢抱怨。
所以,AB1842关于房东不能终止租约的条款,不是没有理由的。至于是否会被坏人利用,是一个值得讨论的问题。但是讨论的起点是,房客在没有犯错的情况下,你才不能请他走。
附:房客如果犯了以下错误,房东可以让房客走
(b) For purposes of this section, “just cause” includes either of the following:
(1) At-fault just cause, which is any of the following:
(A) Default in the payment of rent. (不付租)
(B) A breach of a material term of the lease, as described in paragraph (3) of Section 1161 of the Code of Civil Procedure, including, but not limited to, violation of a provision of the lease after being issued a written notice to correct the violation. (违反租约的主要条款,我认为宠物或者客人住时间太长等等)
(C) Maintaining, committing, or permitting the maintenance or commission of a nuisance as described in paragraph (4) of Section 1161 of the Code of Civil Procedure. (对邻居有骚扰)
(D) Committing waste as described in paragraph (4) of Section 1161 of the Code of Civil Procedure. (破坏租房财产)
(E) The tenant had a written lease that terminated on or after January 1, 2020, and after a written request or demand from the owner, the tenant has refused to execute a written extension or renewal of the lease for an additional term of similar duration with similar provisions, provided that those terms do not violate this section or any other provision of law. (房客拒绝签续约)
(F) Criminal activity by the tenant on the premises, including any common areas, or any criminal threat, as defined in subdivision (a) of Section 422 of the Penal Code, directed at any owner or agent of the owner of the premises. (犯罪行为)
(G) Assigning or subletting the premises in violation of the tenant’s lease. (当二房东)
(H) The tenant’s refusal to allow the owner to enter the dwelling pursuant to a request consistent with Section 1954 of the Civil Code. (拒绝房东进入维修)
(I) Using the premises for an unlawful purpose as described in paragraph (4) of Section 1161 of the Code of Civil Procedure.
