misconduct is an arguable term. there are many reasons for someone to be fired. i see no reason that he could not apply for the benefits. was he fired because he stole something? was he fired because he damaged something on purpose? was he fired because he did not come to work for days? was he fired because he was playing pingpong for 8 hours without working? if not, why couldn't he apply for the benefits?
