I think what you are saying is: make a relatively-low offer, and let the Seller know that his/her agent gets 3% commission, so the Seller is left with the extra money. 

Since I am tending the offer to the Seller's Agent, do you think they might just not tender the offer to Seller?  Usually it is hard to talk to Seller directly.
