Check your local law, my state requested in-person delivery of eviction letter (or stick it outside the door) and hand it to the tenants. My state law asks for 30 day notice in advance for eviction. However my judge said following the lease; if it was not stated in lease, follow teh state law. I guess, signed lease is your legal backbone.
Here is the process:
Evict them in court first for not paying the rent, the late fee and other charges you can think of. On court day, tell judge that you want them move out (file for a possession on the paper you obtained from court house in advance) since you already delviered the eviction letter. Judge will give them more days to pay you the money they owed you in stead of letting you file for possession. Then, you did another round of letter delivery, court day, such and such circles. This process is lengthy and effort comsuming. Be prepared for long term-battle. I actually have to give them some money to "invite" them out of my house.
How identical to my case. The behavior in their first month payment reflected their long term behavior. Never never trust people with that kind of behavior at teh beginnign. They will always pay, bu will always be late. It depends on how comfortable you are about them. I hate people being delayed. Regardless, be determined to evict them ASAP since they will be the pain the ass in every month. It's my own brutal lesson.
