Having read the whole story, I think you have 70% responsibility. I think that picture is Ms. Colorofthewind's 独创. Many flowers, such as tulip, sunflower, have been photographed countless, not only the first is 独创, all others are simply copies. That is unacceptable for any photographer even they are quite similar. The reason is that she photographed the picture herself without others help. You can see that these two pictures are clearly different. It is impossible that some one confused by their similarity. It does not matter whether she saw the picture you posted.

It will be much better if you question her 独创 in easy way. It seems that you are too serious about 独创. To be honest, I would feel unhappy if you question me that way.
