If your gap falls within the grace period, you do not need to go back to China. However, technically you cannot work during the gap because evidently your h2b starts from 10/01. If you are serious about the law, you should work out some solution, such as taking a vacation during the gap. Your company's counsel clearly has little knowledge of immigration law.
