The traffic light on the car should say all. We also have witness who would like to prove it. The city did not try to argue the accident. However, in letter from city it states that: A governmental entity is granted governmental immunity for its actions involving governmental functions, unless the immunity is expressly waived by the state legislature. Under present law, the city is not legally liable for the unfortunate events that you have identified. Further the city has no liability, the Texas Constitution prohibits the city for paying public monies on our claim. Our car is covered by insurance company, it costs $6000 to repair. The insurance company has given up the claim to city perhaps they received same letter. However the driver, my wife was also injured.
All in all, we think it is unfair to be like this. So we would like to try it, nothing we can lose. Last week, I wrote a letter to the Congressman in our district and hope he can help somehow. Anyway it would be great if you guy can provide any suggestions.
