(A)並不是說Traffic Light掉落在您車上就一定是當地政府的錯,基本上您需要證明當地政府在明知有問題的情況下(notice of a defect)但是沒有做出適當的回應. (防止意外的發生或是維修)您才真正有可能可以對於這個意外提出求償的訴訟,因為如果交通燈是在正常的使用情況下,因為任何銹蝕加上交通的經過導致路面的震盪最後鬆脫掉落,或是因為有強風(超過其所設計的能抵抗風阻的最高上限)鬆脫掉落,都屬於不能抗拒的意外狀況,在這種情況下,當地政府都可能勿需要負責.
