帮忙看看，我们是否符合treaty?

我去年3月从德国博士毕业，来美国做博士后h1b，不知道自己是否符合treaty，有的人说符合，有的人说要从国内直接来的可以，可我是中国国籍。难道必须从国内直接来的才符合treaty，希望明白的人指点一下！谢谢！
